5.2 Payment Schedule

Payment terms and schedule will be specified in the booking form at the time of booking and will form part of the project contract. The payment structure will be customized based on:

The detailed payment schedule, including amounts and due dates, will be clearly outlined in the booking form and project agreement signed by both parties.

  • Premium materials beyond standard specifications
  • Changes in project scope after commencement
  • Site preparation and utility connections

6. CLIENT RESPONSIBILITIES

6.1 Site Access and Preparation

Clients must ensure:

  • Unhindered site access for workers and materials
  • Safe working environment and necessary permits
  • Existing furniture removal and storage arrangements
  • Utility connections and infrastructure readiness
  • Compliance with society/building regulations

6.2 Decision Making and Approvals

Clients must provide:

  • Timely approvals for designs and material selections
  • Clear communication of preferences and requirements
  • Access to decision-makers throughout the project
  • Prompt resolution of any concerns or modifications

7. COMPANY OBLIGATIONS

7.1 Quality Assurance

We commit to:

  • Use of quality materials from certified suppliers
  • Skilled workmanship adhering to industry standards
  • Regular quality checks and progress monitoring
  • Compliance with safety and building regulations
  • Timely project completion as per agreed timeline

7.2 Professional Standards

8. WARRANTIES AND GUARANTEES

8.1 Workmanship Warranty

  • Structural Work: 2 years from completion
  • Electrical and Plumbing: 1 year from completion
  • Painting and Finishes: 1 year from completion
  • Furniture and Fittings: As per manufacturer warranty
  • Hardware and Accessories: 6 months from installation

8.2 Material Warranty

  • Original manufacturer warranties apply to all materials
  • Replacement of defective materials at no additional cost
  • Regular maintenance guidelines provided
  • Post-warranty support available at nominal charges

9. INTELLECTUAL PROPERTY

9.1 Design Rights

  • All original designs remain intellectual property of Maity Decor
  • Clients receive usage rights for the specific project
  • Designs cannot be reproduced without written consent
  • Custom designs created specifically for clients become their property

9.2 Third-Party Materials

  • Respect for third-party intellectual property rights
  • Proper licensing for patented or copyrighted materials
  • Client responsibility for any unauthorized usage

10. LIMITATION OF LIABILITY

10.1 Scope of Liability

Our liability is limited to:

  • Direct costs related to defective workmanship
  • Replacement or repair of non-conforming work
  • Refund of payments for undelivered services
  • Maximum liability capped at the total contract value

10.2 Exclusions

We are not liable for:

  • Consequential or indirect damages
  • Loss of business or anticipated profits
  • Delays due to circumstances beyond our control
  • Damage to pre-existing conditions not disclosed
  • Third-party claims or intellectual property disputes

11. FORCE MAJEURE

Neither party shall be liable for delays or failures in performance due to:

  • Natural disasters, floods, earthquakes, or severe weather
  • Government actions, regulations, or policy changes
  • Labor strikes, lockouts, or industrial disputes
  • Material shortages or supply chain disruptions
  • Pandemic, epidemic, or public health emergencies
  • Any other circumstances beyond reasonable control

12. CANCELLATION AND REFUND POLICY

12.1 Client-Initiated Cancellation

  • Before Work Commencement: 90% refund after deducting design charges
  • During Design Phase: 70% refund after deducting completed work value
  • During Execution Phase: Refund based on work not executed
  • Post 50% Completion: No refund eligible

12.2 Company-Initiated Cancellation

  • Full refund of all payments received
  • Compensation for any inconvenience caused
  • Assistance in finding alternative service providers

13. PRIVACY AND DATA PROTECTION

13.1 Information Collection

We collect and use client information for:

  • Project planning and execution purposes
  • Communication regarding project progress
  • Legal and regulatory compliance requirements
  • Marketing communications (with consent)

13.2 Data Security

  • Secure storage of client information
  • Limited access to authorized personnel only
  • No sharing with third parties without consent
  • Data retention as per legal requirements

14. DISPUTE RESOLUTION

14.1 Amicable Resolution

  • Initial resolution through direct communication
  • Mediation through mutually agreed mediator
  • Good faith efforts to resolve disputes promptly

  • Jurisdiction limited to courts in Durgapur, West Bengal
  • Disputes governed by Indian laws and regulations
  • Arbitration as per Arbitration and Conciliation Act, 2015

15. GENERAL PROVISIONS

These Terms are governed by the laws of India and subject to the jurisdiction of courts in Durgapur, West Bengal.

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15.3 Entire Agreement

These Terms constitute the entire agreement between the parties and supersede all prior negotiations, representations, or agreements.

These Terms may only be modified through written agreement signed by both parties. Updates to general terms will be posted on our website with effective dates.

15.5 Assignment

Clients cannot assign their rights or obligations under these Terms without our written consent. We may assign our rights to affiliated companies or successors.

  • Adherence to Indian Contract Act, 1872

  • GST registration and tax compliance
  • Environmental clearances where applicable
